Wholeday Terms of Use
Effective October 18, 2026 · Version 1
These terms are an agreement between you and STI Financial LLC, doing business as Wholeday, of Temecula, California ("Wholeday", "we", "us"). They cover the Wholeday app for iPhone (the "App") and wholedayapp.com (together, the "Service").
Please read section 14 (Disputes). It requires most disputes to be resolved by individual arbitration, not class actions or jury trials, unless you opt out within 30 days.
By downloading or using the Service you agree to these terms and to our Privacy Policy and Consumer Health Data Privacy Policy. If you don't agree, don't use the Service.
1. Who can use Wholeday
You must be 18 or older and able to form a binding contract. The App is for personal, non-commercial use.
2. What Wholeday is, and isn't
Wholeday is a tracking and organizing tool. It helps you record your medications, food, weight, fasting and activity, and see them together.
Wholeday is not medical care. In particular:
- It is not medical advice, diagnosis or treatment, and using it doesn't create a doctor-patient or any other provider relationship.
- It is not a medical device, not a telehealth service and not a pharmacy. It doesn't prescribe, sell or supply any medication.
- It never tells you what dose to take, when to change a dose, or how to mix, measure or schedule a medication. Follow your prescriber and your pharmacy label.
- Don't start, stop, skip or change any medication, dose or treatment because of anything in the Service, including the AI coach or anything you read in our content.
- Medication levels, phases, calorie targets, goal dates and other projections are estimates. They're calculated from published averages and what you log, and your body may differ. They're for illustration, not for treatment decisions.
- Food and nutrition information comes from public databases (USDA FoodData Central, Open Food Facts) and from what you enter. It may be incomplete or wrong. The label on the package takes priority.
- Wholeday isn't monitored by anyone. In an emergency, call 911 (or your local emergency number). For a mental health crisis in the US, call or text 988.
- Talk to your healthcare provider before changing your diet, exercise or medication, especially if you are pregnant or breastfeeding, have diabetes or take glucose-lowering medication, or have a history of disordered eating. See our Health Disclaimer.
No outcome guarantees. We don't promise any weight, health or medication result.
No affiliation. Wholeday isn't affiliated with, endorsed by or sponsored by any drug manufacturer, pharmacy, compounding pharmacy, telehealth provider, or Apple. Medication names in the App are used only to identify what you're tracking.
3. Your data
- Your health data is stored on your iPhone. We don't receive it or keep a copy, except as described in the Privacy Policy (for example the website waitlist).
- You're responsible for backups. If your iPhone is lost, damaged or reset without a backup, your data can't be recovered by us. Backups are optional and can be encrypted with a password only you know; if you forget that password, we can't recover the backup.
- You own what you enter. You give us no rights to it, and we don't use it to train AI.
4. The AI coach (optional)
- Questions you pick from the coach's list are answered on your iPhone without AI.
- If you add your own Anthropic API key and turn the AI coach on, questions you type are sent from your iPhone to Anthropic's Claude, with only the kinds of data you allow (for example, Apple Health readings are included only if you allow Health data for the coach), plus the time and which screen you opened the coach from. Your use of Claude is also governed by Anthropic's terms, and Anthropic bills you directly. Wholeday doesn't include or pay for AI usage.
- AI answers can be wrong, incomplete or out of date. Check them, and don't rely on them for medical decisions.
- The coach can suggest changes to what you've logged (for example logging food, water or a weigh-in, marking a dose taken or skipped, correcting a dose's time or site, or editing your meal plan). Nothing changes until you tap Confirm, and most changes can be undone.
- The coach isn't built to set or change dose amounts or schedules, to add, archive or delete a medication, or to change AI or privacy settings, and it has no way to make those changes.
- The app doesn't automatically include your name, birth date, notes, lab results or photos in the data supplied to the AI coach. Anything you type into an AI conversation is sent to Anthropic.
5. Subscriptions, the free trial and prices
- What's included: a subscription unlocks all of Wholeday. You can explore the App with made-up sample data without subscribing.
- Prices: $49.99 a year, or $9.99 a month. Prices may vary by country and are shown in the App before you buy.
- Free trial: the yearly plan includes a 7-day free trial for people who haven't had one. We'll remind you in the App 2 days before it ends. Unless you cancel at least 24 hours before the trial ends, it converts to a paid yearly subscription and your Apple ID is charged $49.99. The monthly plan has no trial.
- Auto-renewal: subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period.
- How to cancel: iPhone Settings → your name → Subscriptions → Wholeday. Deleting the App does not cancel your subscription.
- Billing and refunds are handled by Apple under the App Store's terms. We can't issue refunds directly; request one at reportaproblem.apple.com.
- Price changes: we'll give advance notice through Apple, and you can cancel before a new price applies.
- When a trial or subscription ends: dose reminders you've already set keep working, and your data is never locked: you can view, export, back up, restore or delete it. Other features stop until you subscribe again.
- Purchases are private: Apple processes payment; we don't receive your name, Apple ID or payment details.
6. Acceptable use
Don't use the Service to:
- give dosing advice to others, or present anything from the App as medical advice;
- buy, sell or source illegal, counterfeit, unapproved or unverified drugs;
- make misleading health claims in anything you share from the App;
- break the law, infringe others' rights, or interfere with the Service (including reverse engineering, except where the law allows it).
7. Our content and license to you
We own the App, the website and their content. We give you a personal, revocable, non-transferable license to use the App on Apple devices you own or control, under these terms and Apple's Usage Rules.
8. Changes to the Service and these terms
We may change or stop features. If we make material changes to these terms, we'll update the effective date and tell you in the App or by email before they apply. If you keep using the Service after that, the new terms apply.
9. Ending the agreement
You can stop at any time by deleting the App (and cancelling any subscription in Settings). We may suspend or end your access if you seriously break these terms. Sections 2, 3, 9–17 continue after the agreement ends.
10. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that estimates, food data or AI answers will be accurate.
11. Limitation of liability
To the fullest extent the law allows:
- we're not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, profits or goodwill;
- our total liability for all claims relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
Some places don't allow these limits, so they may not apply to you.
12. Indemnity
You agree to cover our reasonable losses and legal costs from claims caused by your misuse of the Service or your breach of these terms, to the extent the law allows.
13. Apple
These terms are between you and Wholeday, not Apple. Wholeday, not Apple, is solely responsible for the App and its content. Your license is limited to using the App on Apple-branded products you own or control, as the App Store's Usage Rules allow. Wholeday is solely responsible for maintenance and support of the App (contact us at [email protected]), and Apple has no obligation to provide any. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); otherwise Apple has no warranty obligation. Apple isn't responsible for claims about the App, including product liability, legal or regulatory compliance, or consumer protection claims. Wholeday, not Apple, is responsible for investigating, defending and settling any claim that the App infringes someone's intellectual property. You must follow any third-party terms that apply when you use the App (for example your wireless carrier's). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you're not in a US-embargoed country or on a US government restricted-party list. Questions, complaints or claims about the App go to Wholeday at the contact details in section 17.
14. Disputes: informal resolution, then individual arbitration
- Talk to us first. Before filing a claim, send a written notice describing it to [email protected]. We'll try to resolve it informally within 60 days.
- Individual arbitration. If we can't, either of us may start binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration is held remotely or in your county. For claims under $10,000, we pay the filing and arbitrator fees.
- No class actions or jury trials. Claims are brought only individually, not as a class, collective or representative action.
- Mass filings. If 25 or more similar claims are filed by the same or coordinated counsel, they're handled under the AAA's Mass Arbitration Supplementary Rules: claims proceed in batches, with a small number decided first as bellwethers, and the rest wait while those are decided. Fees are charged per batch as those rules provide. Nothing here stops a court from deciding whether a claim must be arbitrated.
- Public injunctive relief. If the law where you live doesn't allow you to waive a request for public injunctive relief (for example in California), that request is decided by a court after the individual arbitration ends.
- Small claims court is always available for claims within its limits.
- Opt out: you can opt out of this section within 30 days of first accepting these terms by emailing [email protected] with your name and "Arbitration opt-out". Opting out doesn't affect anything else.
- Time limit: to the extent the law allows, claims must be brought within one year after they arise.
15. Governing law
California law governs these terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 14.
16. General
If any part of these terms is unenforceable, the rest stays in effect. Not enforcing a term isn't a waiver. You can't transfer these terms; we may transfer them in a reorganization or sale. These terms, the Privacy Policy, the Consumer Health Data Privacy Policy and the Health Disclaimer are the whole agreement.
